国家发改委今日公布《反价格垄断规定》,禁止具有竞争关系的经营者达成固定或者变更价格的八种价格垄断协议。
National Development and Reform Commission on Tuesday unveiled new pricing regulations to prevent price-setting collusion between competitors and the abuse of market dominance to charge unfair prices.
近日,国家发展改革委依据《中华人民共和国反垄断法》,制定并公布了《反价格垄断规定》和《反价格垄断行政执法程序规定》,并已于2010年12月29日以国家发展和改革委员会令第7号和第8号公布,将于2011年2月1日起实施。
The new pricing regulations are based on the framework established by China's previously adopted anti-monopoly law. A draft of the rules was issued on Dec.29th, 2010 by the National Development and Reform Commission said in a pair of statements, and will be put in to effect on feb.1st,2011.
根据国家发展改革委公布的《反价格垄断规定》,对价格垄断协议、滥用市场支配地位和滥用行政权力等价格垄断行为的表现形式、法律责任作了具体规定。主要包括:禁止具有竞争关系的经营者达成固定或者变更价格的八种价格垄断协议;禁止经营者与交易相对人达成固定商品转售价格和限定商品最低转售价格的协议;具有市场支配地位的经营者,不得从事不公平高价销售、不公平低价购买、在价格上实行差别待遇、附加不合理费用等六类价格垄断行为。
new pricing regulations states that the form of price of monopoly such as Setting prices by agreement, Abuse of Market Power as well as executive power and legal liability.Under the new regulations, competitors will be banned from reaching agreements to fix prices, or setting minimum resale prices. Companies with large market share will be barred from charging 'unfairly high prices' for their goods, and from paying 'unfairly low prices' for inputs.
《反价格垄断规定》指出,禁止具有竞争关系的经营者达成下列八种价格垄断协议:
(一)固定或者变更商品和服务(以下统称商品)的价格水平;
(二)固定或者变更价格变动幅度;
(三)固定或者变更对价格有影响的手续费、折扣或者其他费用;
(四)使用约定的价格作为与第三方交易的基础;
(五)约定采用据以计算价格的标准公式;
(六)约定未经参加协议的其他经营者同意不得变更价格;
(七)通过其他方式变相固定或者变更价格;
(八)国务院价格主管部门认定的其他价格垄断协议。
